A Historic 6–3 Ruling Reaffirms Constitutional Guarantee of Citizenship for Nearly Everyone Born on US Soil
The US Supreme Court has struck down President Donald Trump’s executive order restricting birthright citizenship, marking a major setback for one of the administration’s signature immigration initiatives and reaffirming the constitutional guarantee of citizenship for nearly everyone born in the United States.
In a 6–3 decision, Chief Justice John Roberts wrote for the majority that Trump’s order violated the Fourteenth Amendment, which has long been interpreted to grant automatic citizenship to individuals born on US soil and subject to the country’s jurisdiction. The ruling reaffirmed the Court’s long-standing interpretation of the Constitution and the precedent established in the landmark 1898 case United States v. Wong Kim Ark.
