Qatar Foundation Secures $275 Million in Sidra Hospital Dispute

The Qatar Foundation (QF) has emerged victorious in a protracted legal battle over the construction of Sidra Medicine, a premier academic medical center in Doha. The International Chamber of Commerce (ICC) arbitration tribunal has awarded the Doha-based organization approximately one billion Qatari rials, equivalent to $275 million, in compensation.

The dispute, originating nearly two decades ago, involved a joint venture between Spain’s Obrascon Huarte Lain and Contrack Cyprus Ltd, a subsidiary of Egypt’s Orascom Construction. The conflict centered around defaults and delays in the construction of Sidra Medicine, prompting QF to terminate its contract with the joint venture in 2014 and initiate arbitration proceedings.

The tribunal’s decision this week affirms a previous ruling that validated QF’s termination of the contract. This ruling marks a significant milestone in what has been a challenging path to justice for QF, confirming their stance and awarding them substantial compensation, with additional awards on costs pending.

A spokesperson for Qatar Foundation expressed satisfaction with the outcome, stating, “QF welcomes the award issued by the ICC, which further vindicates QF’s position in this long-standing dispute.” The spokesperson emphasized that the award reflects QF’s unwavering commitment to high standards of project management and accountability.

QF plans to reinvest the compensation into the Sidra Medicine endowment, enhancing its capacity to deliver personalized healthcare, particularly for women, children, and young people facing rare and genetic diseases in Qatar, the Middle East, and Africa.

Sidra Medicine stands as a cutting-edge healthcare and research institution, emphasizing clinical research to provide specialized care. The facility is dedicated to transforming healthcare delivery in the region, with a focus on innovative treatments and personalized patient care.

The legal journey did not come without challenges. The joint venture’s attempts to overturn partial awards in favor of QF were dismissed by the High Court of England and Wales in both 2018 and 2019.
